This training covers the regulatory framework for financial activities of an unlicensed foreign financial institution in and into Germany from a third country, i.e., from outside of the European Economic Area (EEA). The presentation entails the German cross-border rules governing topics such as financial promotion and advertising relating to banking and investment services, negotiation of financial services agreements, provision of banking and investment services and cooperation with third parties (finders, business introducers and External Asset Managers). We will also briefly discuss cross-border licenses and Freistellung exemptions in this context. In addition, this webinar highlights the German tax regulations related to cross-border investment services offered from a third country to a German private investor. The aim is to consider the tax impact of financial investments within the framework of a discretionary management (or advisory) mandate, mitigating the commercial and civil law risks.
