New Product Line – Cryptos Overview

In a highly dynamic regulatory landscape, BRP SA is pleased to announce the launch of its new product line dedicated to the provision of crypto-asset related activities/services.
The CRYPTOS OVERVIEW is based on BRP’s expertise in financial regulation. It enables you to quickly gain an overview of existing bans and restrictions as well as licensing requirements, allowing you to better manage the cross-border risks of your business model.
The CRYPTOS OVERVIEW provides an overview of the legal and regulatory framework applicable to cross-border crypto-assets related activities/services provided by a foreign (unlicensed) crypto-asset service provider (“CASP”).
It focuses on the following types of crypto-assets:
- Payment tokens;
- Security tokens;
- Utility tokens.
The activities/services which may be carried out in accordance with the applicable laws and regulations in the target country include:
- Advertising activities (such as the active presentation of crypto-asset related services and the provision of related marketing material during on-site meetings or via remote means of communication, as well as the restrictions on the use of websites);
- Custody services;
- Investment services (such as execution only, advisory and discretionary asset management services).
- In this context, the relevant factors for the provision of cross-border activities/services related to crypto-assets, such as the localisation of the activity, exemptions from the legal and regulatory framework and “current market practices” are addressed.

The BEHAVIOUR TEMPLATE reflects the principles set out in the REGULATORY OVERVIEW document using schematic “dos and don’ts”. It further contains a short description of the scope of the CRYPTOS OVERVIEW and a reference to the DEFINITIONS AND CONCEPTS document.
